These Terms and Conditions (“Terms”) govern all services provided by Arikserv (“we,” “us,” or “our”). By purchasing any service or placing an order through our website, you (“you,” “your,” “the client”) agree to these Terms in full. If you do not agree, you should not proceed with any purchase.
1. Scope of Service
Arikserv provides website design services and related digital deliverables. Our services may include website design, Wix website builds, logo creation, website maintenance, and additional optional add-ons listed on our website. We do not sell or provide website hosting, domain registration, email hosting, or any Wix subscription plans. All hosting, domain, and platform fees are paid directly to Wix by the client.
Before any work begins, the specific scope of your project will be based on the package and add-ons you selected. Anything not explicitly included in your chosen plan is considered outside the project scope and may require an additional fee. We reserve the right to decline requests that significantly deviate from the agreed scope or that require third-party services we do not provide.
2. Project Requirements and Client Responsibilities
A project begins only after you provide all required materials needed to complete the work. Required materials may include written content, images, branding, functional requirements, login access, and any information needed for add-on features. You are fully responsible for providing original, legally-owned materials. If you supply content that infringes on third-party rights, you accept full liability for any resulting claims.
We cannot complete or progress a project without the necessary information. Any delays caused by incomplete materials, unclear instructions, or slow responses will extend the delivery timeline. You understand that delivery estimates are based on receiving full and prompt cooperation.
3. Payments and Start of Work
All payments are processed through Stripe. You must submit payment only after providing us with all necessary information. Work will not begin until payment has been successfully received. Once payment is made and work has begun, it becomes non-refundable (see Section 10). No alternative payment methods are accepted unless discussed and agreed to in writing.
4. Delivery Timelines
Delivery timelines are listed within the available packages on our website. These timelines represent estimated delivery windows. Actual delivery time may vary depending on workload, project complexity, and how quickly you provide required information.
If you request features beyond the original scope, the delivery date will be extended accordingly. We are not responsible for delays caused by third-party services (including Wix), internet outages, or circumstances beyond our control.
5. Revisions and Scope Changes
Each project includes one revision round unless otherwise stated. A revision round allows you to request adjustments to the existing design such as text changes, image replacements, layout refinements, or corrections when something does not match the originally agreed plan.
Requests that alter the functionality or layout in a substantial way, add new pages, introduce new features, or require significant restructuring are considered “scope changes” and are not included in the revision round. Scope changes require additional payment, and we will provide a quote before proceeding.
6. Ownership of the Website
Once the final design has been delivered and payment has been made in full, you own the completed website content. The website must remain hosted on the Wix platform, and you are responsible for maintaining an active Wix subscription for the site to remain live. We do not own, manage, or bill you for your Wix account or subscription fees.
7. Portfolio Rights
Arikserv retains the right to display completed projects in our portfolio, marketing materials, social media, or case studies. If you do not want your website displayed publicly, you must notify us in writing before the final delivery. Otherwise, we assume permission is granted.
8. Third-Party Assets and Licensing
During the design process, we may use third-party assets (such as images, icons, fonts, or plugins). We ensure we follow proper licensing requirements for assets we supply. If you request premium or licensed materials that require payment, you will be responsible for those costs.
You must ensure that any materials you provide are legally owned, licensed for commercial use, or properly attributed. You accept liability for any legal issues arising from content provided by you.
9. Ongoing Support and Maintenance
Support included with your package is limited to the timeframe listed on the plan. Once the support period ends, any additional help, troubleshooting, or changes will require a maintenance fee or a new support agreement. If you choose to request ongoing website maintenance, we will discuss the details including the scope of support and any associated fees before agreeing to the work.
10. Refund and Cancellation Policy
All payments are final. We do not offer refunds under any circumstances.
Once work has begun, the project cannot be canceled. If you decide to stop the project, the fee remains non-refundable. If you fail to provide required materials, the project will remain paused indefinitely until you do so, but no refunds will be issued. We encourage all clients to ensure they are ready to proceed before submitting payment.
If we determine that a project cannot continue for any reason (such as repeated unpermitted requests, abusive behavior, or violations of these Terms), we reserve the right to terminate the project. In such cases, no refund will be issued.
11. SEO and Performance Disclaimer
While we follow good design and structural practices, we do not guarantee any specific results related to:

Search engine indexing

Performance improvements

Sales or conversion outcomes
SEO performance depends on numerous factors outside of our control, including market competition, your ongoing activity, and how you choose to maintain the site after delivery.
12. Limitation of Liability
To the fullest extent permitted by Irish law, Arikserv is not liable for any indirect, incidental, or consequential damages. This includes lost revenue, lost business, lost data, platform outages, or losses resulting from Wix service issues.
Our responsibility is limited to delivering the design and services outlined in your purchased package. We are not responsible for website downtime, platform issues, changes within the Wix ecosystem, or content supplied by the client.
13. Communication Expectations
We primarily communicate through email or digital messaging. You must respond within reasonable timeframes to keep the project moving. Prolonged periods of no communication may result in delays.
14. Governing Law
These Terms are governed by the laws of Ireland. Any disputes must be resolved through the courts of Ireland.
15. Updates to These Terms
We may update these Terms at any time. The most recent version will always be published on our website. Continued use of our services after changes means you accept the updated Terms.
